H. B. 2339
(By Delegates Prezioso, Gallagher, Staton, Douglas,
Jenkins, Leach and Mezzatesta)
[Introduced February 2, 1995; referred to the
Committee on the Judiciary.]
A BILL to repeal sections twelve and thirteen, article four,
chapter sixty-two of the code of West Virginia, one thousand
nine hundred thirty-one, as amended, relating to the
requirement that the clerk of the circuit court annually
prepare a list of fines imposed in criminal matters for the
state auditor and further imposing a penalty for failure to
prepare and transmit such report to the auditor.
Be it enacted by the Legislature of West Virginia:
ARTICLE 4. RECOVERY OF FINES IN CRIMINAL CASES.
§1. Repeal of sections relating to preparing of list of fines
by circuit clerk for auditor and imposing a penalty
for failure to prepare and transmit such report.
Sections twelve and thirteen, article four, chapter
sixty-two of the code of West Virginia, one thousand nine hundred
thirty-one, as amended, are hereby repealed.
NOTE: The purpose of this bill is to repeal sections twelve
and thirteen of article four, chapter sixty-two, of the code of
West Virginia inasmuch as the requirement for preparation of a
list of fines for the auditor is now obsolete and is not used by
the auditor and constitutes an unnecessary burden and cost for
counties.
